A firm protested the Department of the Treasury's decision to set aside a procurement under the Small Business Administration's (SBA) 8(a) program, contending that the 8(a) set-aside would violate certain provisions of the Federal Acquisition Regulations (FAR), since the procurement was previously effected through a small business set-aside. GAO held that: (1) FAR and SBA regulations did not preclude an 8(a) award where a small business set-aside was previously used; (2) FAR did not require a repetitive small business set-aside; and (3) the protester provided no evidence that SBA failed to consider whether the 8(a) set-aside would adversely impact other small business programs or an individual small business. Accordingly, the protest was dismissed.
