A firm protested an Army solicitation for mineplows, contending that the Army: (1) improperly used its proprietary technical data in its solicitation; (2) improperly released its protected information to its competitors; and (3) should not have set aside the solicitation for small businesses. GAO held that the Army: (1) obtained the legal rights to use the protester's technical data in its solicitation; (2) properly used the protester's technical data to conduct the foreign military sales procurement; and (3) properly set aside the solicitation, since it expected bids from at least two responsive small businesses. Accordingly, the protest was denied.
