A firm protested a Department of Veterans Affairs (VA) purchase order for medical training courses and materials, contending that: (1) the awardee was not a small business; and (2) VA should have terminated the contract after the Small Business Administration determined that the awardee was not a small business. GAO held that VA should have terminated the contract and made award to the protester, since it was the only eligible small business. Accordingly, the protest was sustained and GAO recommended that VA reimburse the protester for its bid and protest preparation costs.
