A firm protested a U.S. Marshals Service (USMS) contract award for the towing, storage, and disposal of seized and forfeited vehicles, contending that the awardee failed to provide required evidence of its intent to lease each proposed vehicle storage site. GAO held that: (1) the facility requirement did not constitute a definitive responsibility criterion; (2) the solicitation did not require proof of a 5-year lease committment for a storage facility; and (3) USMS reasonably concluded that the awardee would obtain a long-term lease for its proposed storage facility after the expiration of its current lease. Accordingly, the protest was denied.
