The spouse of a deceased Navy member claimed entitlement to his Survivor Benefit Plan (SBP). GAO held that the claimant was not eligible to receive the member's SBP benefits, since the: (1) retired service member died within 1 year of their marriage; and (2) service member's adoption of her child prior to his death did not fulfill the issue of marriage requirement. Accordingly, the claim was denied.
