A firm protested a Bureau of Prisons (BOP) nonappropriated fund instrumentality (NAFI) contract award for vending machine services, contending that BOP improperly circumvented competitive procurement requirements by procuring the services through the NAFI. GAO held that the: (1) NAFI was not a federal agency, and its procurements were not subject to GAO review; (2) solicited services were part of a NAFI requirement; and (3) Navy did not benefit significantly in the procurement process. Accordingly, the protest was denied.
