[Protest of DPSC Contract Award for Clothing]
Highlights
A firm protested a Defense Personnel Support Center (DPSC) contract award for clothing, contending that DPSC: (1) improperly awarded the contract without competition; (2) did not properly justify the noncompetitive award; (3) failed to reasonably evaluate the awardee's production capability; and (4) did not properly determine the reasonableness of the awardee's price. GAO held that: (1) the protester untimely challenged DPSC use of an industrial exception to full and open competition; (2) DPSC reasonably determined that the awardee was capable of producing the required items; and (3) DPSC conducted multiple price analyses of the awardee's bid and properly determined that the awardee's price was fair and reasonable. Accordingly, the protest was dismissed in part and denied part.
