[Retired Navy Officer's Request for Waiver of Indebtedness]

A retired Navy member requested waiver of his indebtedness for active duty pay he erroneously received upon his retirement, contending that he was led to believe that the payment was correct. GAO held that the member: (1) should have known that the payment was erroneous, since he received his final pay one month earlier; (2) should have questioned the discrepancy in his bank statement and taken action to return the erroneous payment; and (3) was liable for the amount of the overpayment. Accordingly, the waiver was denied.
