The Department of Energy (DOE) requested: (1) an opinion on the validity of the DOE Inspector General (IG) election to retain his Senior Executive Service salary instead of the higher Executive Level IV salary; and (2) authorization to void the election and retroactively correct the IG salary rate. DOE contended that the election was invalid, since the IG acted on incorrect advice or misunderstood the impact of his election. In addition, DOE requested that the IG be allowed to exercise a change in the corrected salary rate in order to be eligible for the 1992 special pay adjustment for law enforcement officers. GAO held that: (1) the election could not be voided, since it did not result from unjustified or unwarranted DOE personnel action; (2) IG was entitled to a waiver of indebtedness for the salary overpayments he received, since the overpayments were due to administrative error and he was not at fault; and (3) IG could take advantage of the special pay adjustment for law enforcement officers.
