[Former State Department Employee's Claim for Waiver of Overpayment]

A former Department of State employee requested reconsideration of his denied request for waiver of an erroneous lump-sum leave payment. GAO held that: (1) State erroneously overpaid the employee due to administrative errors; (2) the employee should have known that the payments were erroneous, since he received two regular salary payments after his retirement and two lump-sum leave payments that totalled more than he was entitled to receive; and (3) the employee never apprised State of the erroneous salary and lump-sum payments. Accordingly, the denial of waiver was sustained.
