[Protest of Proposed Air Force Contract Award for Transponder System]

A firm protested a proposed sole-source Air Force contract award for a transponder system, contending that the Air Force: (1) improperly determined that the awardee was the only responsible source capable of meeting its needs; and (2) unreasonably determined that its bid was technically unacceptable. GAO held that the: (1) protester untimely filed its protest against the Air Force's determination of its minimum needs more than 45 days after the Air Force announced its intent to award a sole-source contract; (2) Air Force's invitation to the protester to demonstrate its equipment did not supplant the timeliness requirement; (3) Air Force reasonably evaluated the protester's technical bid; and (4) Air Force reasonably determined that the protester was not a responsible source for the required equipment and properly made a sole-source award to the awardee. Accordingly, the protest was denied in part and dismissed in part.
