A firm protested two Navy nonappropriated fund instrumentality (NAFI) contract awards for a cable television system, contending that: (1) the awards violated its franchise agreement with the Navy; and (2) the NAFI merely acted as the Navy's agent. GAO held that: (1) violations of the protester's franchise agreement were matters of contract administration and not subject to GAO review; (2) the NAFI was not a federal agency, and its procurements were not subject to GAO review; and (3) the NAFI was not acting as the Navy's agent, since the Navy did not participate significantly in the procurement process. Accordingly, the protests were dismissed.
