A former Air Force employee claimed overtime pay for meal periods during his regularly scheduled daily tour of duty and on days of paid leave for the 6 years prior to his retirement. GAO held that the employee was: (1) not entitled to overtime pay for the periods he was in a paid leave status; and (2) entitled to overtime pay for the meal periods during his 8.5 hour duty days beginning 2 years before the date he filed his claim, since the applicable law imposed a 2-year statute of limitations. Accordingly, the claim was partially allowed.
