A reemployed annuitant for the Department of Labor (DOL) requested waiver of a salary overpayment, contending that: (1) he advised appropriate officials on numerous occasions regarding the overpayments; (2) repayment would cause him extreme financial hardship; and (3) GAO should consider recent regulations regarding reemployment of retirees without penalties. GAO held that: (1) the claimant was at fault, since he was aware of the overpayment; (2) financial hardship was not a valid basis for waiver; and (3) such regulations were not in effect when DOL hired the claimant. Accordingly, the request for waiver was denied.
