The Food and Nutrition Service (FNS) requested a decision about whether it: (1) could incrementally fund nonseverable contracts for expert and consulting services; or (2) must fully obligate funds at the time of contract award. GAO held that FNS lacked the statutory authority to incrementally fund contracts that it could not separate for performance by fiscal year. Accordingly, FNS must record the nonseverable contracts as obligations and fully cover the costs of those contracts at the time of award.
