A firm protested a Department of Veterans Affairs (VA) contract award for elevator maintenance, contending that VA: (1) failed to provide it with a copy of the solicitation; and (2) improperly failed to set the procurement aside for small businesses. GAO held that: (1) the VA failure to furnish the protester with a copy of the solicitation did not adversely affect competition; (2) VA did not intentionally exclude the protester from the competition; and (3) the protester untimely filed its protest regarding the small business set aside. Accordingly, the protest was dismissed.
