[Protest of DLA Award for Drug Testing Kits]

A firm protested a Defense Logistics Agency (DLA) contract award for drug testing kits, contending that the awardee's product did not meet the solicitation specifications. GAO held that: (1) DLA relaxed the specifications for the awardee, which prejudiced all other offerers in the competitive range; and (2) failed to allow other offerers to compete under the relaxed specifications. Accordingly, the protest was sustained, and GAO recommended that DLA: (1) review the product requirements; (2) reassess its minimum needs; (3) amend the solicitation and allow competitive range offerers to submit revised proposals, if appropriate; (4) make award to the protester if the original solicitation reflected its minimum needs; and (5) reimburse the protester for its protest costs.
