A firm protested a Defense Logistics Agency (DLA) contract award for electromagnetic relays, contending that DLA relaxed a material solicitation requirement by allowing the awardee to change its delivery terms. GAO held that DLA improperly: (1) relaxed the required delivery terms for the awardee; and (2) conducted discussions with only the awardee by relaxing the delivery terms. Accordingly, the protest was sustained, and GAO recommended that DLA: (1) reopen discussions with all bidders in the competitive range; and (2) reimburse the protester for its protest costs.
