The Nuclear Regulatory Commission (NRC) requested a decision regarding the propriety of rescheduling commissioner pay days that occur on holidays or weekends, contending that commissioners could not cash their checks or receive the appropriate credit for Thrift Savings Plan contributions when pay days occurred on nonworking days. GAO held that: (1) NRC could administratively reschedule commissioner pay days to the preceding working day; and (2) Congress did not authorize NRC to make advance salary payments to commissioners. Accordingly, NRC could pay commissioners for work actually performed on the rescheduled pay days.
