A joint venture protested a Corps of Engineers contract award for facility construction, contending that the Corps: (1) improperly rejected its bid because it was not a small disadvantaged business; and (2) should have awarded it the contract as the low bidder. GAO held that the Corps properly rejected the bid, since the: (1) protester did not qualify as a small disadvantaged business in accordance with solicitation specifications; and (2) small business concern that qualified the joint venture lacked the funds and experience necessary to perform the contract, and did not have majority control over the joint venture. Accordingly, the protest was denied.
