A firm protested a Navy contract award for underwater breathing equipment, contending that the: (1) awardee lacked the technical knowledge to perform the contract; (2) Navy improperly omitted Buy American provisions from the solicitation; and (3) Navy should have set aside the procurement for small businesses. GAO held that: (1) it would not review the Navy's affirmative determination of the awardee's responsibility; and (2) the protester untimely filed after bid opening its protests against alleged solicitation improprieties. Accordingly, the protest was dismissed.
