[Protest of SBA Denial of COC]

A firm protested the Small Business Administration's (SBA) decision to deny it a certificate of competency (COC), following Army Corps of Engineers and Air Force nonresponsibility determinations under solicitations for electrical replacements, contending that the: (1) Air Force and the Corps acted in bad faith by misapplying or misrepresenting its performance history and referring their subsequent nonresponsibility determinations to SBA; (2) Corps improperly refused to provide it copies of the performance evaluations; and (3) SBA acted in bad faith by ignoring information on its COC application. GAO held that: (1) it would not review the responsibility determinations, since the protester did not show that the Corps or the Air Force acted in bad faith; (2) the Corps was not required to provide the protester with copies of its performance evaluations; and (3) SBA properly considered all information in the protester's application during COC proceedings. Accordingly, the protests were denied.
