A firm protested a Maritime Administration (MARAD) contractor's subcontract award for a boiler combustion control system, contending that: (1) the contractor improperly determined that its bid was nonresponsive; and (2) MARAD failed to notify GAO of its intent to proceed with contract performance while the protest was pending. GAO held that the: (1) protester's bid failed to clearly indicate compliance with delivery requirements; and (2) MARAD procedural failure to notify GAO of its decision to proceed with contract performance did not prejudice the protester. Accordingly, the protest was denied.
