The Forest Service requested a decision regarding the applicability of certain statutory requirements on oil and gas royalties. GAO determined that: (1) neither the monthly payment requirement of the Mineral Lands Leasing Act nor the interest penalty provision of the Federal Oil and Gas Royalty Management Act applied to oil or gas royalty payments from national forest lands; and (2) such payments were subject to annual payment requirements. Accordingly, the Forest Service was not required to collect monthly royalty payments.
