A firm protested a U.S. Customs Service solicitation for software development and operational support for a command, control, communications, and intelligence system, contending that: (1) Customs improperly amended the solicitation by adding a restrictive service requirement; and (2) it was entitled to award, since the requirement was encompassed under its prior contract. GAO held that: (1) the protest was academic, since Customs cancelled and resolicited the requirement under a separate and unrestricted solicitation; and (2) it would not consider the sole-source award contention, since Customs did not order the services due to limited funding and the protester's prior contract had expired. Accordingly, the protest was dismissed.
