A firm protested any Army Corps of Engineers contract award to another bidder for wall construction, contending that the Corps, during discussions: (1) discouraged it from revising its bid; and (2) misrepresented the importance of technical and cost considerations. GAO held that the: (1) protester untimely filed its protest regarding the Corps' alleged disallowance of bid modifications and misinformation regarding evaluation criteria importance; and (2) Corps properly awarded the contract to the low bidder, since its and the protester's bids were technically equal. Accordingly, the protest was dismissed.
