[Decision Concerning Former Air Force Under Secretary's Request for Waiver of Salary Overpayments]

The Air Force forwarded a former undersecretary's request for waiver of indebtedness for salary overpayments he received over 3 years. The Air Force advised that it failed to deduct the correct retirement amount from the undersecretary's salary payments. GAO held that the claimant: (1) was not at fault in accepting his salary; and (2) could elect to withdraw the contributions the Air Force should have made to the retirement fund. Accordingly, waiver was granted.
