A retired Air Force employee requested reconsideration of the partial denial of his request for waiver of retired pay. GAO held that: (1) the claimant should have known that any increase in his government salary would result in a decrease in retired pay; (2) there was no legal basis to disregard dual compensation and pay cap restrictions; and (3) the employee was obligated to refund the additional payments of retired pay he received after the increase in his salary. Accordingly, the original decision was affirmed, and the request for additional waiver was denied.
