The Navy requested a decision regarding the social security offset against a retired Navy officer's widow's survivor annuity. The claimant contended that the offset exceeded her actual social security benefit, since she had elected to receive reduced benefits prior to the time she reached full retirement age. GAO held that the social security offset against the claimant's survivor annuity could not exceed the actual social security benefits she received. Accordingly, the claim was allowed, and GAO recommended that the claimant's annuity be adjusted.
