[Decision Concerning Waiver of Retired Air Force Officer's Widow's Indebtedness for Erroneous Payments of Retired Pay]

The widow of a deceased retired Air Force officer requested waiver of a debt resulting from her receipt of erroneous payments of retired pay from the Air Force after her husband's death. GAO held that the widow was entitled to a waiver of indebtedness, since: (1) she accepted the payments as survivor benefits after other government agencies had acknowledged her husband's death; and (2) it would be against equity and good conscience and not in the best interest of the government to collect the debt. Accordingly, waiver was granted.
