A firm protested a Marine Corps contract award for dummy load generator sets, contending that: (1) a pre-bid conference transcript furnished prospective bidders did not constitute a formal solicitation amendment, and was therefore nonbinding; and (2) the awardee's bid was nonresponsive, since it failed to include a price for the required provisioning data. GAO held that the: (1) solicitation specifically referenced the transcript as a material amendment which corrected certain duplicative data requirements; and (2) alleged bid defect concerned a bid price for the duplicative data. Accordingly, the protest was denied.
