[Protest of SBA and DLA Procedures Under Solicitation for Fire Retardant Trousers]

A firm protested the Small Business Administration's (SBA) and the Defense Logistics Agency's (DLA) procedures under a solicitation for fire retardant trousers, contending that the agencies' failure to allow it sufficient time to complete its certificate-of-competency application constituted bad faith. GAO held that: (1) the protester failed to provide any evidence that SBA or DLA acted in bad faith; (2) SBA attempted to obtain an application extension for the protester; and (3) DLA had the discretion to refuse to grant the application extension period. Accordingly, the protest was dismissed.
