The Department of Agriculture (USDA) requested a decision regarding whether it should pay a state's emergency telephone service charges for telephone calls. GAO held that: (1) the service charges were actually taxes; and (2) states could not require the federal government to pay taxes. Accordingly, USDA should not pay the charges.
