[MSPB Decision Not Subject to GAO Review]

The Army requested a decision concerning its payment of an award of compensatory damages to a retired employee as provided for in a Merit Systems Protection Board (MSPB) decision. GAO held that: (1) MSPB had exclusive authority to decide employee appeals of adverse agency actions; and (2) the MSPB decision constituted the legal basis necessary to make the payment. Accordingly, GAO declined jurisdiction.
