[Protest of Navy Contract Award for Survival Kits]
Highlights
A firm protested a Navy contract award for survival kits to another firm, contending that the: (1) Navy failed to apply its evaluation criteria in evaluating bids; (2) Navy did not include qualification testing as an evaluation factor; and (3) awardee did not demonstrate its ability to produce the required kits. GAO held that the protester: (1) abandoned its protest against the Navy's evaluation procedures, since it failed to respond to the Navy's rebuttal of the allegation; and (2) untimely filed its protest concerning the alleged solicitation deficiencies. GAO would not consider the protest against the Navy's affirmative determination of the awardee's responsibility. Accordingly, the protest was denied in part and dismissed in part.
