A firm protested any Department of Health and Human Services (HHS) contract award for uniform and dust control equipment rental, contending that: (1) it was unable to submit a bid because HHS failed to send it the solicitation materials; and (2) HHS should resolicit the requirement. GAO held that: (1) HHS published notice of the solicitation in the Commerce Business Daily and mailed a solicitation package to the protester's proper address; and (2) the protester failed to show that HHS deliberately excluded it from competition. Accordingly, the protest was denied.
