[Protest Against Any Navy Contract Award for Tug and Towing Services]

A firm protested any Navy contract award for tug and towing services for military shipping, contending that the: (1) Navy planned to remove the small business set-aside restriction from the solicitation; (2) Navy refused to disclose certain information concerning the wage determination; and (3) solicitation did not meet the Navy's needs concerning delivery orders. GAO held that: (1) the contention that the Navy would withdraw the restriction was premature and without supporting evidence; (2) it would not review the protester's contention that the solicitation should have been more restrictive; and (3) since the protester was the incumbent, it was on notice of the undisclosed information and was not prejudiced by the alleged nondisclosure. Accordingly, the protest was dismissed.
