The Defense Logistics Agency (DLA) requested a decision regarding two employees' claims for retroactive promotions and backpay. The claimants contended that: (1) DLA issued a job announcement guaranteeing them the promotions after a specified time period; and (2) a classification review unjustifiably delayed their promotions. GAO held that the claimants were not entitled to retroactive promotions, since: (1) the job announcement did not constitute DLA regulation or policy; and (2) DLA had no nondiscretionary policy or regulation requiring retroactive promotion. Accordingly, the claims were denied.
