A firm protested a Customs Service solicitation for automatic currency readers, contending that Customs improperly: (1) changed the solicitation from a small business set-aside to an unrestricted procurement; (2) excluded it from the competition; and (3) provided a copy of its protest to the awardee. GAO held that: (1) the protester untimely filed after bid opening its contention concerning alleged solicitation improprieties; (2) it would not disturb Customs' determination that the protester was not in the competitive range, absent a showing that the determination was unreasonable, arbitrary or violated procurement laws; and (3) Customs was required to furnish copies of the protests to interested parties, unless the protester specifically identified protected information. Accordingly, the protest was denied in part and dismissed in part.
