The Army requested a decision concerning whether a retired Army officer who applied his military service toward a civil service retirement annuity could elect to provide a military survivor benefit annuity for his dependent child. GAO held that: (1) since the officer was eligible for civil service survivor benefits, he could not provide a military annuity for his child; and (2) the Office of Personnel Management had sole authority regarding a waiver of the child's civil service annuity. Accordingly, the Army should not allow election to provide the annuity.
