A firm protested a Department of the Interior contract award for a flatbed plotter and related support services, contending that: (1) the solicitation improperly included a liquidated damages clause; (2) Interior, by requesting the protester's best and final offer after it protested the requirement, in effect relaxed the liquidated damages requirement; and (3) the Buy American Act prohibited the procurement of foreign-made goods. GAO held that: (1) it would not consider the allegation concerning the liquidated damages clause, which the protester untimely filed after bid opening; (2) Interior did not waive the liquidated damages requirement; and (3) the Buy American Act did not prohibit procurement of foreign-made products. Accordingly, the protest was denied.
