[Protest of Army Contract Award for Plastic Magazines for Automatic Weapon System]
Highlights
A firm protested an Army sole-source contract award for plastic magazines for an automatic weapon system, contending that the Army improperly awarded the contract using noncompetitive procedures after cancelling the original solicitation. GAO held that: (1) the award was proper, since the awardee was the only bidder both capable of meeting the urgent delivery requirements and eligible for waiver of the first-article test; (2) the Army could not consider the protester for award without a thorough preaward survey; (3) the awardee's contract price was low and in line with the prices obtained under the most recent competitive procurement for the items; and (4) the Army's decision to cancel and resolicit because of its urgent requirements was reasonable. Accordingly, the protest was denied.
