A discharged naval member requested a waiver of: (1) the debt he incurred while he was in the service as a result of an overpayment of his military pay and allowances; and (2) the interest payment the Navy charged on the amount due, in the event GAO affirmed the Claims Group's determination. GAO held that: (1) the employee was at fault since he either knew or should have known that he was taking leave that he had not earned; and (2) the employee was not required to pay the interest charge on the debt during the time his request for waiver was pending. Accordingly, the Claims Group's denial was affirmed.
