[Decision Concerning GPO Employee's Entitlement to Overtime Pay]

The U.S. Government Printing Office (GPO) requested an advance decision regarding whether: (1) an employee could retain overtime pay for hours he worked in his civilian position after he reported for the first day of active duty training with his Air Force Reserve unit; and (2) GPO should charge him military leave for the first day of his military duty. GAO noted that: (1) the Air Force allowed the employee to leave the base after he performed some military duties on his first day of active duty, which was a Sunday; (2) the employee then returned to GPO and worked the overtime hours; (3) Sunday was not a regularly scheduled workday for the employee; and (4) GPO did not require the employee to perform the overtime. GAO held that: (1) the employee was not entitled to receive overtime pay for his work at GPO, since he had already reported for active military duty; and (2) GPO should not charge the employee military leave for his first day of active military duty, since Sunday was not a regularly scheduled workday for him. Accordingly, the overtime pay the employee received should be collected from him, and no military leave should be charged for his first day of military duty.
