A firm protested the Defense Logistics Agency's (DLA) rejection of its bid under a solicitation for water indicating paste, contending that: (1) its failure to insert a bid price for first article testing indicated that it did not intend to charge for such testing; and (2) DLA failed to promptly notify it of the bid rejection. GAO held that: (1) DLA properly rejected the bid as nonresponsive because the protester failed to include any indication as to its intended price for first article testing; and (2) the protester was not materially prejudiced by the DLA failure to promptly notify it of the bid rejection. Accordingly, the protest was dismissed.
