A firm protested a Navy contract award for a cold storage warehouse, contending that its low bid should not have been rejected as late. GAO held that: (1) although the Navy lost the protester's time-stamped bid envelope, there was evidence that several minutes elapsed between the time the protester submitted its bid to Navy personnel and the time the Navy actually stamped the bid; (2) the Navy confirmed that the protester submitted its bid prior to bid opening; and (3) the Navy should terminate the awardee's contract for convenience and award the contract to the protester. Accordingly, the protest was sustained.
