[Request for Decision Concerning Propriety of Payment]

The Department of Education requested a decision concerning the propriety of the payment of certain contract proceeds to the contractor-assignor rather than to the assignee. GAO found that, since the assignee abrogated its settlement agreement with Education and filed a complaint in the Claims Court, the question of an administrative settlement was moot. Accordingly, the claim should not be paid.
