[Protests of DLA Rejection of Bids]

A firm protested the Defense Logistics Agency's (DLA) rejection of its bids under two solicitations for medical supplies. DLA found that the protester was nonresponsible under both solicitations as a result of a preaward survey which found that the protester was delinquent in its performance on pending contracts for similar supplies. GAO will not question an agency's nonresponsibility determination absent a showing of agency bad faith or lack of reasonableness. GAO found that the protester failed to support its allegation of bad faith and that DLA had a reasonable basis for its determination. Accordingly, the protests were denied.
