GAO was asked how it would reply if an advance opinion was requested on whether the salaries of incumbent bankruptcy judges could be certified for payment. Sections of the Bankruptcy Amendments and Federal Judgeship Act of 1982 extend the term of office of the incumbent judges and provide for the payment of their salaries. These provisions must be considered to be constitutional, in the absence of a definitive ruling to the contrary.
