A firm protested a Service Contract Act wage determination incorporated into a Navy solicitation for custodial services. The protester complained that the wage determination was inconsistent with a collective bargaining agreement covering the employees involved and would result in its being underbid by competitors who were unaware that they would be required to perform according to the agreement. GAO held that it does not review the accuracy of wage rate determinations issued in connection with solicitations subject to the Service Contract Act. In addition, GAO determined that the protester was not at a disadvantage in the bidding since all bidders were on notice that the wage determination specified only minimum wages and benefits and the awardee would be required to comply with the collective bargaining agreement. Accordingly, the protest was dismissed.
